Personal Data Processing Agreement
In accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter referred to as the "GDPR"), the Supplier (hereinafter referred to as the "Processing Operator") and you (hereinafter referred to as the "Controller") enter into contractual relations on data processing in order to determine the conditions for processing personal data, the method of their protection, and also determine other rights and obligations of both parties when processing personal data of data subjects on behalf of the Controller during the implementation of the Subject of these Terms as the main contract.
1. Processing of personal data
The services provided in accordance with these Terms and Conditions include the processing of information related to an identified or identifiable individual and specified in the Privacy Policy (hereinafter referred to as Personal Data)
2. Authorization
The Controller authorizes the Processing Operator to process Personal Data, including the following instructions:
(i) "Processing Purpose" means the provision of services in accordance with these Terms. The processing Operator has only the right to process Personal Data on behalf of the Controller in relation to the provision of services requested by the Controller. All information collected for additional purposes is processed outside the contractual relationship between the Controller and the Processing Operator.
(ii) processing period means the period from entering into cooperation, in accordance with these Terms, until the termination of the provision of services;
(iii) the scope and categories of personal data should include general personal data, excluding any and all special categories of personal data;
(iv) "Data subject" means an individual as an authorized user of Controller devices,
(v) processing operations mean all operations, without exception, necessary for the purpose of processing;
(vi) "Documented Instructions" means the instructions described in these Terms and Conditions, their Appendices, Privacy Policy and Service documentation. The Controller is responsible for the legal permissibility of the processing of Personal Data by the Processing Operator in relation to the relevant applicable provisions of data protection legislation.

3. Duties of the Processing Operator
The processing operator is obliged to:
(i) process Personal Data only on the basis of documented instructions and for the purposes defined in the Terms, Annexes thereto, Privacy Policy and Service documentation;
(ii) ensure that persons authorized to process Personal Data undertake to respect confidentiality and follow documented instructions;
(iii) comply with the measures described in the Terms and Conditions, their Annexes, Privacy Policy and Service Documentation;
(iv) assist the Controller in responding to requests from Data Subjects related to their rights. The Processing Operator must not correct, delete or restrict the processing of Personal Data without a corresponding instruction from the Controller. All requests of Data Subjects related to Personal Data processed on behalf of the Controller must be forwarded to the Controller without delay.
(v) assist the Controller in notifying the supervisory authority and the Data Subject regarding the leakage of Personal Data;
(vi) delete or return all Personal Data to the Controller at the end of the Processing Period;
(vii) maintain an up-to-date register of all categories of processing operations that he performed on behalf of the Controller;
(viii) make available to the Controller all the information necessary to demonstrate compliance under these Terms and Conditions, their Annexes, Privacy Policy and Service documentation.
4. Involvement of another processing operator
The processing operator has the right to engage another processing operator to perform certain processing operations, such as providing cloud storage and infrastructure for the service, in accordance with these Terms, its Annexes, Privacy Policy and service documentation.
5. Processing area
The processing operator guarantees that the processing takes place in the European Economic Area or in a country designated as safe by the decision of the European Commission based on the decision of the Controller. At the request of the Controller, standard contractual conditions apply in the case of transfers and processing carried out outside the European Economic Area or a country designated as safe by the decision of the European Commission.
6. Security
The processing operator is certified according to ISO 27001:2013 and uses the ISO 27001 platform to implement a multi-level protection strategy when applying security measures at the level of the network, operating systems, databases, applications, personnel and operational processes. Compliance with regulatory and contractual requirements is regularly assessed and analyzed similarly to other infrastructure and operations of the Processing Operator, and the necessary measures are constantly taken to comply with compliance. The processing operator organized data protection using ISMS based on ISO 27001. Security documentation mainly includes program documents for information security, physical security and equipment protection, incident management, data leak handling, security incidents, etc.
